Turkey Arbitration

Turkey is a Contracting State to the ICSID Convention:

  • Signature: 24 June 1987
  • Deposit of Ratification: 3 March 1989
  • Entry into Force: 2 April 1989
  • On 8 October 1998, pursuant to Article 25(3) of the ICSID Convention, Turkey designated 2 consituent subdivisions/agencies as compentant to be parties to an ICSID arbitration: 1) Turkish Electricity Generation and Transmission Corporation (TEAS); 2) Petroleum Pipeline Corporation (BOTAS) 
  • On 3 March 1989, Turkey notified ICSID that it only submits to ICSID jurisdiction with respect to the "disputes arising directly out of investment activities which have obtained neccessary permission, in conformity with the relevant legislation of...Turkey on foreign capital, and that have effectively started shall be subject to [ICSID jurisdiction]. However, the disputes, related to the property and real rights upon the real estates are totally under the jurisdiction of the Turkish could and therefore shall not be submitted to [ICSID jurisdiction]."
  • Pursuant to Article 13(1) of the ICSID Convention Turkey has made the following panel designations effective until 9 January 2011:
    - Dr. Yusuf ÇALIŞKAN: Assistant Professor of Law, Kocaeli University
    - Dr. Mehmet KÖMÜRCÜ: Attorney
    - Prof. Dr. Cernal ŞANLI: Professor of Private International Law, Istanbul University
    - Dr. Ĭlhan YILMAZ: Adjunct Professor of Private International Law, Galatasary University

Turkey is a Contracting State to the New York Convention:

  • Date of Accession: 2 July 1992
  • Entry into Force: 30 September 1992
  • Turkey will only apply the New York Convention to the recognition and enforcement of awards made in the territory of another contracting state & only to differences arising out of legal relationships, whether contractual or not, that are considered commercial under their national law

In 2001, Turkey enacted legislation based on the UNCITRAL Model Law on International Commercial Arbitration as adopted in 1985 and is therefore now popularly considered to be an UNCITRAL Model Law State
