Tunisia is a Contracting State to the ICSID Convention:

  • Signature: 5 May 1965
  • Deposit of Ratification: 22 June 1966
  • Entry into Force: 14 October 1966
  • Pursuant to Article 54(2) of the ICSID Convention, Tunisia has designated “Tribunal de Première Instance having jurisdiction in the place where the enforcement is to take place” as competent for the recognition and enforcement of ICSID awards.
  • Pursuant to Article 69 of the ICSID Convention, Tunisia enacted the Loi No. 66-23 du 3 mai 1966 portant ratification de la Convention pour le règlement des différends relatifs aux investissements entre Etats et ressortissants d’autres Etats (Off. Gaz. May 3-6, 1966, p. 723) to make the Convention effective in their jurisdiction.
  • Pursuant to Article 13(1) of the ICSID Convention Tunisia has made the following panel designations effective until 27 February 1986:

    - Mr. Nourreddine KOOBA: Directeur Général du Budget, Ministère des Finances

Tunisia is a Contracting State to the New York Convention:

  • Date of Accession: 17 July 1967
  • Entry into Force: 15 October 1967
  • Tunisia will only apply the New York Convention to the recognition and enforcement of awards made in the territory of another contracting state & only to differences arising out of legal relationships, whether contractual or not, that are considered commercial under their national law

In 1993, Tunisia enacted legislation based on the UNCITRAL Model Law on International Commercial Arbitration as adopted in 1985 and is therefore now popularly considered to be an UNCITRAL Model Law State
